1. Acceptance of Terms
By accessing or using KinCare360's services, you agree to be bound by these Terms of Service and all applicable laws. If you do not agree, please do not use our services.
2. Description of Services
KinCare360 provides non-medical care coordination services including:
- Daily family check-in phone calls (non-clinical)
- Routine reminder notifications for family-approved everyday routines
- Appointment reminder and family coordination support
- Communication and reporting to family members
- Phone-based local service connection support
KinCare360 is an AI-powered coordination service and does not provide clinical assessments, medical diagnoses, healthcare treatment, appointment scheduling guarantees, provider-side case management, prescription handling, or healthcare communications as a medical representative.
3. NOT a Medical Service — No Medical Advice
KinCare360 expressly does NOT provide:
- Medical advice, diagnosis, or treatment
- Clinical assessments or health evaluations
- Nursing, home health aide, or skilled nursing services
- Emergency medical services or crisis intervention
- Medication administration, instructions, or management
- Mental health counseling or therapy
Any health-related information shared by KinCare360 is for informational and coordination purposes only and does not replace the advice of a licensed healthcare professional. Always consult a qualified physician or healthcare provider for medical decisions.
4. Emergency Services Disclaimer
KinCare360 is NOT an emergency service.
In an emergency or immediate danger, call 911 immediately. Do not rely on KinCare360 for emergency response or urgent intervention. KinCare360 cannot guarantee response times and is not equipped to handle emergencies, investigations, emergency dispatch, or urgent professional intervention. By using our services, you acknowledge that KinCare360 shall have no liability for delays in communication or inability to respond to emergency situations.
5. Family Follow-Up Notices
KinCare360 is not an emergency, crisis counseling, suicide-prevention, medical, or in-home care service. KinCare360 may send family/safety contacts non-medical family follow-up notices when a caller shares an everyday concern, request, missed check-in, or coordination need that may require family attention. These notices do not mean Lily verified an emergency or medical issue, and KinCare360 cannot guarantee help will arrive. They mean a caller shared something that may warrant family follow-up. In an emergency or immediate danger, call 911.
6. Privacy & Health Information
KinCare360 is a non-medical care coordination service. We are not a Covered Entity or Business Associate under HIPAA. We do not provide medical treatment, and the information you share with us (such as routine preferences, appointment times, errands, and general family notes) is used solely for coordination purposes.
We implement reasonable administrative, technical, and physical safeguards to protect your information. We treat personal and health-related details with care and confidentiality, but KinCare360 is not a medical record system, clinical chart, medication-management tool, medication-compliance service, or emergency monitoring record.
We will never sell your personal or health-related information. Information shared is used only to provide the care coordination services you have requested. For full details, see our Privacy Policy.
7. Subscriptions, Free Trial & Payments
KinCare360 offers a 7-day free trial. Your payment method will not be charged until the trial period ends. After 7 days, your subscription will automatically renew monthly at the plan rate you selected unless cancelled before the trial ends.
Payments are processed securely by Stripe. KinCare360 does not store credit card information.
8. Cancellation & Refunds
You may cancel your subscription at any time. Cancellations take effect at the end of the current billing cycle. To cancel, contact us at hello@kincare360.com or call +1 272 766 9090. Refunds are evaluated on a case-by-case basis.
9. Limitation of Liability
To the maximum extent permitted by law, Son Healthcare Services LLC, operating as KinCare360, shall not be liable for:
- Any medical outcomes, health deterioration, or injury
- Missed routines, appointments, or family follow-ups
- Failure to receive, forward, or act on a family follow-up notice shared by a caller
- Any indirect, incidental, special, or consequential damages
- Damages exceeding the amount paid to KinCare360 in the 30 days prior to the claim
You agree that KinCare360 is a supplemental support service and is not a substitute for professional medical care, in-home care, or emergency services.
10. Indemnification
You agree to indemnify and hold harmless Son Healthcare Services LLC, its officers, employees, and agents from any claims, damages, or expenses (including attorney fees) arising from your use of our services, your violation of these Terms, or your reliance on KinCare360 communications as medical advice.
11. SMS Communications
Account owners may consent during signup using an optional mobile phone field and a separate optional, unchecked SMS consent checkbox, or during intake. Family members and safety contacts provide their own consent at https://www.kincare360.com/family-consent after being added to a family profile. By submitting the applicable SMS consent form, providing a mobile phone number, and checking the optional SMS consent checkbox, you expressly agree to receive recurring automated SMS messages from KinCare360 at the phone number provided. Messages include daily check-in notifications, family-approved routine reminders, appointment updates, service/account notices, family concern notifications, time-sensitive non-medical family follow-up notices, daily summaries, and service alerts.
- Message frequency: up to 5 messages per day
- Message and data rates may apply
- Consent is not required to purchase services
- People who do not provide a mobile phone number and do not check the optional SMS consent checkbox will not receive recurring text updates
- Reply STOP to cancel at any time
- Reply HELP for assistance

12. Governing Law
These Terms shall be governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Philadelphia County, Pennsylvania.
13. Changes to Terms
We reserve the right to update these Terms at any time. Continued use of our services after changes constitutes acceptance of the new Terms.
